Anatomy of a Criminal Search



Overview:

Criminal Record Searches are primarily requested in order to determine a subjects past relationship with the law. This is especially important if the subject will be in close contact with (1) the public; (2) a loved one; (3) children or the elderly; and/or (4) valuables. A few examples would include: nannies, baby-sitters, house-cleaners, potential business associates, etc.

Legal Restrictions:

Because criminal filings are a matter of public record, there are almost no restrictions and may be ordered on any individual. Unlike credit reports, you need not obtain consent from the subject of your inquiry, nor demonstrate a need for the information. Federal law not only permits, but requires, that courts provide the public with access, (usually in-person), to the criminal records in custody of the court. An exception to this rule are records which have been sealed or expunged, or offenses committed by juveniles. These records are not available and will not be reported.
